This User Agreement (the “Agreement”) is entered into by and between Merit Quest Academy, a United States-based online educational platform (“Merit Quest Academy,” “we,” “us,” or “our”), and you, the parent or legal guardian (“you” or “Parent/Guardian”) of a minor child (“Student”) who is permitted to access and use our educational services and website located at https://meritquestacademy.com (the “Site”).

This Agreement outlines your legal responsibilities, rights, and obligations regarding your child’s access to our Services. By permitting your child to use the Site, you agree to the terms outlined herein.

1. Legal Consent to Use of Educational Services

You represent and warrant that:

• You are the parent or legal guardian of the Student who is under 18 years of age;

• You have the legal capacity to enter into this Agreement on behalf of the Student;

• You hereby provide express and informed consent for your child to register for, access, and use Merit Quest Academy’s online courses, educational content, assessments, and digital tools;

• You understand that your child may be communicating with teachers and peers via live video sessions, chat forums, or collaborative assignments as part of the learning experience.

You further acknowledge that all use of the Services by the Student will be subject to the Terms and Conditions and Privacy Policy established by Merit Quest Academy.

2. Parental Review and Acknowledgment of Privacy Practices

You acknowledge that:

• Merit Quest Academy collects personal data from Students in accordance with the Children’s Online Privacy Protection Act (COPPA) and the Family Educational Rights and Privacy Act (FERPA);

• Information collected may include name, email address, contact details, academic performance data, IP address, device usage, and profile images;

• Such data is used solely for educational, operational, and research purposes in accordance with applicable law;

• You have the right to review the personal data collected about your child, request corrections, or request the deletion of such data at any time by contacting admin@meritquestacademy.com

If your child is under the age of 13, your consent to this Agreement shall serve as verifiable parental consent for the purposes of COPPA.

3. Responsibilities of the Parent or Guardian

By entering into this Agreement, you agree to:

• Ensure your child uses the Services in a manner consistent with our academic standards and behavioral expectations;

• Monitor your child’s participation in class discussions, homework submissions, and online conduct while using the platform;

• Safeguard your child’s login credentials and not permit unauthorized users to access their account;

• Maintain accurate contact information within your child’s profile to ensure delivery of academic and safety-related notifications;

• Respond promptly to communications from Merit Quest Academy’s staff regarding student progress, conduct, or technical issues.

4. Consent to Media, Recordings, and Data Use

You understand and agree that:

• Merit Quest Academy may record class sessions for quality assurance, educational reinforcement, or internal training purposes;

• Images, videos, or voice recordings of your child may appear in class recordings or academic materials for internal use;

• Non-identifiable data may be published in academic research, institutional reports, or educational journals for the advancement of online learning methods.

You may opt out of image or voice use by submitting a written request to admin@meritquestacademy.com

5. Communications and Notifications

You consent to receive communications from Merit Quest Academy regarding:

• Enrollment confirmation and account setup

• Class announcements, scheduling changes, and academic reminders

• Student progress, report cards, and performance alerts

• Policy updates, technical issues, or system notifications

• Emergency notifications related to safety or conduct

These communications may be delivered via email, in-platform messaging, or other contact methods you provide. You agree to monitor these communications and ensure timely response when required.

6. Data Security and Retention

You acknowledge that Merit Quest Academy:

• Implements strong data security measures including SSL encryption, firewall protection, and limited-access controls;

• Stores personal data on secure servers located in the United States, in accordance with applicable state and federal laws;

• Will retain student data for up to two (2) years after the student’s final date of activity, unless a longer period is required by law;

• Offers the right to request earlier deletion or data anonymization upon written request by the Parent or Guardian.

You also understand that while the Academy makes reasonable efforts to protect student data, no platform can be completely immune from all security threats.

7. Suspension or Termination of Access

You understand and agree that Merit Quest Academy reserves the right to:

• Suspend or permanently terminate your child’s account if they violate our Terms and Conditions, Code of Conduct, or school policies;

• Restrict access temporarily during investigations into academic dishonesty, disruptive behavior, or technical misuse;

• Notify parents or guardians in writing of any disciplinary decisions and provide documentation where applicable.

All decisions regarding student conduct and access to the platform are made at the sole discretion of the Academy and in accordance with our internal review procedures.

8. Modifications to This Agreement

Merit Quest Academy reserves the right to modify or amend this Agreement at any time. In the event of significant changes, we will notify you through:

Continued use of the Site following any such updates constitutes your acceptance of the modified terms.
