By permitting your child to use the Site, you agree to the terms outlined herein.<\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>1. Legal Consent to Use of Educational Services<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You represent and warrant that:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You are the parent or legal guardian of the Student who is under 18 years of age;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You have the legal capacity to enter into this Agreement on behalf of the Student;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You hereby provide express and informed consent for your child to register for, access, and use Merit Quest Academy\u2019s online courses, educational content, assessments, and digital tools;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You understand that your child may be communicating with teachers and peers via live video sessions, chat forums, or collaborative assignments as part of the learning experience.<\/span><\/span><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You further acknowledge that all use of the Services by the Student will be subject to the <\/span><\/span><span style=\"color: #0000ff;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><u>Terms and Conditions<\/u><\/span><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"> and <\/span><\/span><span style=\"color: #0000ff;\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><u>Privacy Policy<\/u><\/span><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"> established by Merit Quest Academy.<\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>2. Parental Review and Acknowledgment of Privacy Practices<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You acknowledge that:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Merit Quest Academy collects personal data from Students in accordance with the <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Children\u2019s Online Privacy Protection Act (COPPA)<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"> and the <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>Family Educational Rights and Privacy Act (FERPA)<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Information collected may include name, email address, contact details, academic performance data, IP address, device usage, and profile images;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Such data is used solely for educational, operational, and research purposes in accordance with applicable law;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You have the right to review the personal data collected about your child, request corrections, or request the deletion of such data at any time by contacting<\/span><\/span> <a href=\"mailto:admin@meritquestacademy.com\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">admin@meritquestacademy.com<\/span><\/span><\/a><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">If your child is under the age of 13, your consent to this Agreement shall serve as <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>verifiable parental consent<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"> for the purposes of COPPA.<\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>3. Responsibilities of the Parent or Guardian<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">By entering into this Agreement, you agree to:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Ensure your child uses the Services in a manner consistent with our academic standards and behavioral expectations;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Monitor your child\u2019s participation in class discussions, homework submissions, and online conduct while using the platform;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Safeguard your child\u2019s login credentials and not permit unauthorized users to access their account;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Maintain accurate contact information within your child\u2019s profile to ensure delivery of academic and safety-related notifications;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Respond promptly to communications from Merit Quest Academy\u2019s staff regarding student progress, conduct, or technical issues.<\/span><\/span><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>4. Consent to Media, Recordings, and Data Use<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You understand and agree that:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Merit Quest Academy may record class sessions for quality assurance, educational reinforcement, or internal training purposes;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Images, videos, or voice recordings of your child may appear in class recordings or academic materials for internal use;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Non-identifiable data may be published in academic research, institutional reports, or educational journals for the advancement of online learning methods.<\/span><\/span><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You may opt out of image or voice use by submitting a written request to <\/span><\/span><a href=\"mailto:admin@meritquestacademy.com\"><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">admin@meritquestacademy.com<\/span><\/span><\/a><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>5. Communications and Notifications<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You consent to receive communications from Merit Quest Academy regarding:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Enrollment confirmation and account setup<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Class announcements, scheduling changes, and academic reminders<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Student progress, report cards, and performance alerts<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Policy updates, technical issues, or system notifications<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Emergency notifications related to safety or conduct<\/span><\/span><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">These communications may be delivered via email, in-platform messaging, or other contact methods you provide. You agree to monitor these communications and ensure timely response when required.<\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>6. Data Security and Retention<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You acknowledge that Merit Quest Academy:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Implements strong data security measures including <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>SSL encryption<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">, <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>firewall protection<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">, and <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>limited-access controls<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Stores personal data on secure servers located in the <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>United States<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">, in accordance with applicable state and federal laws;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Will retain student data for <\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"><b>up to two (2) years<\/b><\/span><\/span><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\"> after the student\u2019s final date of activity, unless a longer period is required by law;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Offers the right to request earlier deletion or data anonymization upon written request by the Parent or Guardian.<\/span><\/span><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You also understand that while the Academy makes reasonable efforts to protect student data, no platform can be completely immune from all security threats.<\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>7. Suspension or Termination of Access<\/b><\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">You understand and agree that Merit Quest Academy reserves the right to:<\/span><\/span><\/p><ul><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Suspend or permanently terminate your child\u2019s account if they violate our Terms and Conditions, Code of Conduct, or school policies;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Restrict access temporarily during investigations into academic dishonesty, disruptive behavior, or technical misuse;<\/span><\/span><\/p><\/li><li><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">Notify parents or guardians in writing of any disciplinary decisions and provide documentation where applicable.<\/span><\/span><\/p><\/li><\/ul><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: medium;\">All decisions regarding student conduct and access to the platform are made at the sole discretion of the Academy and in accordance with our internal review procedures.<\/span><\/span><\/p><p><span style=\"font-family: Times New Roman, serif;\"><span style=\"font-size: x-large;\"><b>8.
